18 U.S.C. § 2257 Compliance Statement

1. Statement of Compliance

sxyhub.com ("Platform") is committed to full compliance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75, which require producers of visual depictions of actual sexually explicit conduct to maintain records verifying that all performers are 18 years of age or older.

2. Platform Role

2.1 Service Provider Status

  • The Platform operates as an interactive computer service and service provider under 47 U.S.C. § 230 and 17 U.S.C. § 512.
  • The Platform does not produce, create, or direct the content uploaded by users.
  • The Platform acts solely as a hosting and distribution service for user-generated content.

2.2 User Responsibility

  • All content on this Platform is uploaded by independent third-party users.
  • Users who upload content are the "producers" as defined by 18 U.S.C. § 2257.
  • Users are solely responsible for maintaining all required age verification records for performers appearing in their uploaded content.

3. Age Verification Requirements

3.1 Performer Age Certification

All performers depicted in sexually explicit content on this Platform were 18 years of age or older at the time of production.

3.2 Record Keeping

  • Users who upload content must maintain records required by 18 U.S.C. § 2257, including:
    • Government-issued identification of all performers
    • Proof of age at the time of production
    • Performer release forms and consent documentation
    • Custodian of records information

3.3 User Representations

By uploading content, users represent and warrant that:

  • All performers depicted are 18 years of age or older
  • They possess valid age verification records for all performers
  • They have complied with all applicable record-keeping requirements
  • They are the custodian of records or have designated a custodian

4. Custodian of Records

4.1 Platform's Role

The Platform is not the custodian of records for user-uploaded content. Each content uploader is responsible for maintaining their own records or designating a custodian.

4.2 User Obligations

Users must:

  • Maintain records for a minimum of 7 years from the date of production
  • Make records available for inspection by authorized government officials
  • Provide custodian of records information upon request

5. Prohibited Content

The Platform strictly prohibits:

  • Any content depicting or appearing to depict individuals under 18 years of age
  • Any content that violates 18 U.S.C. § 2257 or related regulations
  • Any content lacking proper age verification documentation

Violations will result in immediate content removal and account termination.

6. Reporting and Compliance

6.1 Suspected Violations

6.2 Law Enforcement Cooperation

7. Exemptions

Certain content may be exempt from 2257 record-keeping requirements, including:

  • Content produced prior to July 3, 1995
  • Content that does not depict "actual sexually explicit conduct" as defined by statute
  • Content falling under other statutory exemptions

Users claiming exemptions must still ensure all performers are 18 years or older.

8. Definitions

For purposes of this statement:

  • "Actual sexually explicit conduct" has the meaning set forth in 18 U.S.C. § 2256(2)(A).
  • "Producer" means any person who creates, produces, or directs sexually explicit content.
  • "Performer" means any person depicted in sexually explicit content.
