DMCA Copyright Policy

Effective Date: March 23, 2026

1. Overview

sxyhub.com ("Platform") respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to valid notices of copyright infringement and may terminate accounts of repeat infringers.

2. Filing a DMCA Takedown Notice

If you believe that content on our Platform infringes your copyright, you may submit a takedown notice to our designated DMCA Agent.

2.1 Required Information

A valid DMCA notice must include the following:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.

  2. Identification of the infringing material: A description of where the infringing material is located on the Platform, including:

    • Direct URL(s) to the content
    • Video ID or title
    • Any other information that helps us locate the material

  3. Your contact information:

    • Full legal name
    • Mailing address
    • Telephone number
    • Email address

  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  5. Statement of accuracy: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

  6. Physical or electronic signature: Your physical or electronic signature.

2.2 How to Submit

2.3 Processing Timeline

  • We aim to review and process valid DMCA notices within 48-72 hours.
  • Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing content.
  • We will notify the user who uploaded the content of the takedown.

3. Counter-Notification

If you believe your content was removed in error or misidentification, you may file a counter-notification.

3.1 Required Information

A valid counter-notification must include:

  1. Identification of the removed content: Description and location (URL) of the content before it was removed.

  2. Your contact information:

    • Full legal name
    • Mailing address
    • Telephone number
    • Email address

  3. Statement of good faith belief: A statement, under penalty of perjury, that you have a good faith belief the content was removed due to mistake or misidentification.

  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court in your district (or where the Platform is located if outside the jurisdiction) and that you will accept service of process from the person who filed the original DMCA notice.

  5. Physical or electronic signature: Your physical or electronic signature.

3.2 How to Submit

3.3 Restoration Process

  • Upon receipt of a valid counter-notification, we will forward it to the original complainant.
  • If the complainant does not file a court action within 10-14 business days, we may restore the content at our discretion.

4. Repeat Infringer Policy

  • We maintain a policy of terminating accounts of users who are repeat infringers.
  • Users who receive multiple valid DMCA notices may have their accounts permanently suspended.
  • Determinations of repeat infringer status are made at our sole discretion.

5. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that:

  • Material is infringing, or
  • Material was removed or disabled by mistake or misidentification

may be liable for damages, including costs and attorney's fees.

6. Good Faith Disclaimer

We process DMCA notices in good faith but are not responsible for determining the validity of copyright claims. Copyright disputes should be resolved between the parties involved.
