1. Acceptance of Terms

By accessing or using sxyhub.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

  • By creating an account, you represent and warrant that you are 18 years or older.
  • We reserve the right to request proof of age at any time.
  • Accounts created by individuals under 18 will be immediately terminated.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activities that occur under your account.
  • You must provide accurate and complete information when creating an account.
  • You must notify us immediately of any unauthorized use of your account.
  • You may not transfer or share your account with any other person.

4. User-Generated Content

4.1 Content Standards

  • All content uploaded to the Platform must comply with applicable laws.
  • You may only upload content that you own or have the legal right to distribute.
  • All performers appearing in uploaded content must be 18 years of age or older.

4.2 Prohibited Content

You may not upload, post, or transmit content that:

  • Depicts or appears to depict minors in any sexual or suggestive context
  • Contains non-consensual sexual acts or simulated non-consent
  • Depicts incest or incestuous relationships (including roleplay)
  • Contains bestiality or sexual acts with animals
  • Depicts rape, sexual assault, or coercion
  • Constitutes "revenge porn" or non-consensual intimate imagery
  • Was created using hidden cameras or without subject consent
  • Relates to human trafficking or exploitation
  • Contains extreme violence, gore, or mutilation
  • Violates any third-party intellectual property rights
  • Contains malware, viruses, or harmful code

4.3 Content Representations

By uploading content, you represent and warrant that:

  • You are the copyright owner or have obtained all necessary rights and licenses
  • All performers depicted are 18 years of age or older
  • All performers have provided informed consent to appear in the content
  • You possess all required age verification records as per 18 U.S.C. § 2257
  • The content does not violate any laws or third-party rights

5. License Grant

By uploading content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:

  • Host, store, reproduce, and display your content
  • Distribute and make your content available to other users
  • Create derivative works for platform optimization (e.g., thumbnails, transcoding)
  • Use your content for promotional purposes related to the Platform

This license continues even if you delete your content, to the extent we have cached or archived copies.

6. Content Moderation

  • We reserve the right to review, monitor, and remove any content at our sole discretion.
  • We may remove content that violates these Terms without prior notice.
  • We are not obligated to monitor content but reserve the right to do so.
  • Removal decisions are final and at our discretion.

7. Account Termination

We may suspend or terminate your account immediately if:

  • You violate these Terms or any applicable laws
  • You upload prohibited content
  • You engage in abusive or harassing behavior
  • We receive valid legal complaints about your content
  • We determine termination is necessary to protect the Platform or other users

You may terminate your account at any time by contacting SxyHub Support.

8. Intellectual Property

  • The Platform and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to us in the past 12 months (if any)
  • We are not responsible for user-generated content or third-party actions

11. Indemnification

You agree to indemnify, defend, and hold harmless the Platform, its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your uploaded content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to Terms

  • We reserve the right to modify these Terms at any time.
  • Changes will be effective immediately upon posting to the Platform.
  • Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
  • We will make reasonable efforts to notify users of material changes.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and the Platform regarding your use of the service.
